Your bail presentation should be not more than 5 minutes. Time will be strictly kept by
the markers.
You must also submit the written versionof your oral submissions by 8.00 am on2
June 2025 via the Turnitin link under Assessment 3: Bail Application folder on vUWS.
Failure to do this will result in a fail grade for this assessment. Once submitted, the

Scenario Jacob Hammer is a 47-year-old Maori Law graduate (belonging to the Indigenous people of New Zealand). He is a successful management consultant at a top tier firm in Sydney, where he has been employed for 10 years. Jacob is currently completing accreditation requirements, hoping this will secure him a promotion to partnership in the firm. Jacob holds dual nationality, being a citizen of Australia and New Zealand, and dreams of one day returning to live in New Zealand with his people. One day, the police were called to attend at Jacob’s address. Upon arrival, the police find Jacob standing over his wife screaming: ‘Don’t make me take the kids away from you and make you not see them again! I told you not to get out of the house without my permission. I told you to cut off those friends and sisters of yours! I come home early, and you are not here! Next time, I am taking the kids away and you will never see me or them again.’ The police arrested and charged Jacob under section 54D of the Crimes Act 1900 (NSW). The wife’s sister, who was in attendance during the incident, informed Police that this incident is not an isolated one. Although Jacob had always been a kind and supportive husband and father, two years ago, he developed anger-management problems, causing him to be very controlling of his wife over the course of these two years. Jacob and his wife have four young children aged 5, 6, 8 and 10 respectively. His wife is not employed. She has not been in employment for the last ten years, as she is the primary caregiver for their children. Jacob is the sole breadwinner and an exemplary father. He pays the weekly bills; children’s private schooling; all extra-curricular activities including music lessons and kick-boxing; as well as overseas family holidays every year. He owns the family home, as well as two investment properties in Wollongong. Jacob is a part-time caregiver to his mother who suffers from dementia. He shares caring responsibility with his siblings. He also provides her with financial support to pay for medication. To support his mother, Jacob also volunteers for Dementia Australia. He is the team leader of the monthly fundraising dinner committee. Mrs McCarthy, the volunteer coordinator at Dementia Australia, is willing to confirm Jacob’s good character and his major contributions to Dementia Australia. Jacob is voluntarily undergoing weekly counselling for his anger management problem. Jacob has one prior conviction for common assault dating back 27 years ago. He has one entry in his record for failing to comply with a prior bail acknowledgment requiring him to attend court. Jacob claims that his car broke down on that occasion and he let the court know. The record does not indicate if any action was taken for breach of bail on that occasion. You work for Western Sydney Lawyers and are asked to represent Mr Jacob Hammer. 2
