At the beginning of the 2000s, the Parliament and the European Council issued the so- called "Telecom Package" with the aim of drawing up a regulatory framework of reference for the telecommunications sector, which consists of:
All users in the country have the right to use certain electronic communications services at an established level of quality. The Authority for Communications Guarantees (AGCOM) is therefore entitled to identify the appropriate quality objectives that companies must commit themselves to achieve. AGCOM issued the general criteria relating to the quality of the services offered by the telecommunications companies and the minimum reference provisions for their adoption of publicly available service maps. The Charter of Services is a document that every operator is obliged to adopt to inform users about the offer of services, rights and obligations relating to the contractual relationship and the quality that it undertakes to guarantee to customers and, for operators, is as binding as the contract signed. AGCOM has transposed Law No. 249 of 31 July 1997, whose Article 1 refers to the Authority the competence to resolve disputes between operators and end-users concerning failure to comply with the universal service provisions and the rights of end- users laid down in the legislation, the Authority’s deliberations, contractual conditions and service cards. The Consumer Code that brings together, in a single document, all the legislation to protect the consumer. One of the most important innovations was the introduction of the so-called class action, that is, the procedure of compensation for damage to each member of the group of consumers damaged by the same event. Download the updated Consumer Code in PDF With Legislative Decree No. 21 of 21 February 2014, amendments were introduced to the Consumer Code, transposing Directive 2011/83/EU on consumer rights. This decree provides, in particular, for greater protection against consumers with regard to e-commerce purchases and distance contracts, and increases the number of days on which the consumer can withdraw from the contract to 14 calendar days. In particular, by transposing Regulation (EU) 2018/302, the Code now also includes measures aimed at "to prevent unjustified geographical blocks and other forms of discrimination based on the nationality, place of residence or place of establishment of customers within the internal market".
