After the parties had commenced making their open'mg sub- missions the court gave them a.n opportunity of trying to discuss the mntter at stheir own level with a view to settling some of

the issues.As a resultof the short adjournmentgranted by

the court they were able to resolve three items in dispute.The issue on retirement benefits was withdrawn 'by the claimants

consolitlaled monthly sala'ry in subclauses (i), (ii) and (iii) ks

only for thc purinose: of deterraining what pzrcentage increases are to be given 'to any particular cm ployce. The court rult;s that the opening paragraph of the wage clause overrides t'he

subdauses. The claimants' demand is accordingly rejected as

the coLlrt cannot accept their contention that the respondents 'sslipped in'' certain words in the collective agreement without the claimants'knowledge. It was up to the claimants to makc sure that the co'llective agrcement represented what they had agreed.

House cllowcnce group IV The court 'h'as already referred to thc 'typing error in the grades and the'court'linds thatthe claim ants'.tlem and that tha messanger should get house allowance of KSh. 575 has no morit.After going through the various documents 'the courtis satiylied that the parties had agreed to a house 'allowance of KSh. 250 to 'be paid to mcssengers. The court accordingly linds that the claimants' demand on thîs islue must also fail.

The claknarfts took up 'the matter of their dismissals and

reported a trade dispute to the M inister forLabour and the
mlnistry'slfinding wasthattheir.dismissalwasjustilied forgross
misconductand recommznded that the respondents' decision

should be upheld. The claimants then declded 'to 'bring the m atter to thc IndustrialCourt.

The courtconducted a very fullhearing in this dispute dursng which the aforesaid witnesses gave evidence in addition to the

garties' written and verbal submissions. From the evidence
lt was ssta'blished that tlaa musicians were subject to the rule

of em ploym ent for employees af the rcspondents. In addition tlley were each issued with lctters of appointmen't in whieh the following paragraph which îsvery relevantto the prcsentdispute appears: çlunlcss otherwise instructed your day off wil'l be Sunday and you will play every other day of the week starting at 8 p.m. each evening. Thc incident that 1ed to their summary dismissal töok place

on the new year'seve of 197 9/ 80 forwhich the rcspondents had
advertised a gala dlnner/dance with cabaret and free gîfts.

Thz price was KSh. 235 plus cover charge of KSh- 1 00 pcr person and the court was told, and it has no reason to doubt, that many guests came to the hotel that niglzt with thc result thatthe house was alm osf full.

The respondents'allegation is thatthe grlevahts playing as a band decîded unilateraily to stop playing m usic at a'bout3 a-m.

whiie there were nearly hundred guests stillenjoying the festi-

vities and were showing a 1ot of enthusiasm.W hen they ceased playing the ganeral manager who was prestm t during the night Jntervened and personally instructed the band leader ftnd other musicians that the band should resume playing as the guests wanted entcrtaiiunen: to contintte. They iatly rcfused to o'bey his ordzrs. Thc duty manager, E. W aweru, and 'the maître d'hotel, j. Kariuki, also tried to get tht band to resume play- ing bat.withoutsuccess.A1 1 thc grievants were later seen (after

having changcd 'their uniforms) running towards StarlightC'lub.

The respondentsoventually decided lhat they deservcd sum m ary dismissalfor having wilfully committed an actof insu'bordination and diso'bedience of lawful orders given ,by their superiors. 'T'he claimants stated t 1 'aat the 'band leader--t.. Juma Toto- had an agreement with 'the duty manager and the maitre d'hotel to finish playing 'm usic at 3 a-m .as tlzere warc notmany guests leftby then so they played the closing tune at 3 a-m. and then went to 'thelr changlng roofrt from where they were summoned to the generalmanager in the grillroom bar. They alleged t'hat the generalm anager was drunk and he exchanged loud words w ith them and told them to get back to the stage. After this ' the band decided hto change back into their uniforms to recom- mence plgying music but before they could do so they were told they were not needed any 'more and were told to pack and leave the hotel. The court has carefully evalued the evidence of the various

witnesses and finds that the claimants' version as jiven by

M r.Toto 'to be untrue as 'all t'he respandents'witnesses mcluding the general manager, duty manager and maitre d'hotel during theirevidence stated how they trfed to persuade a11the gricvants to go 'back to the stage and play the music but to no avail. The court iinds that the conduct of these musicians on that nigbtwhich was a new year's eve when guests generally continue

enjoying themselves up 'to 'breakfasttimc indeed constituted a

gross misconduct. The court is satislied that there were over hundred guests present in the hotel at that time including some very 'prominent personalitkes who were a11 looking forward to

enjoying the festivities'foranother couple of hours.Itmay well

.be that the grievants felt that they wzre lbeing overworked bu't thea they had other avenues open to them 'fdr channelling their grievanc-es and not to embark on a course wbich would not only embarrass the respondents 'bu't a'lso cause them jinancial loss as they had to make certain refunds to the guests.

The court is satissed on the evidence of the duty managc'r and the nîaitre d'hotel that thcy did not at any ti.me agree with M r. Toto that he should cease p1'aying 'the 'band at 3 a.m. M r.Toto alzd his colleagues decided to stop playing of their own volilion quite contrary to and in dedance of' their working hours as specified in the let'ters o.f appointm ent. ' ,.

The court fully agrees with the fmding of the'M lhistry bf
Labour that their dismissal was justified for gross misconduct.

From t'he detailsthatwere submitted in the respondents'wrktten submission it appears that a.ll the five grievants were paid their lawfal dues on summary dismissal and the court accordingly

rejects all their demands. It is most unfortunate that these
