Drafting Of Pleading and Conveyancing

(Code K‐505)

Students have to make a Project File under the Name of Sessional Exercise Book. It will carry 50 marks.50 marks are for theory paper, which will be conducted along with the other papers. Marks Sessional Exercise Book and Viva 50 Theory Paper 50

FORMAT OF PROJECT FILE

1. SIZE OF PAPER: Only Plane A4 sheet paper to be used.

2. FRONT PAGE:

It should include I. Name Of College II. Sessional Exercise Book of a) TOPIC b) Subject Name (e.g. DRAFTING OF PLEADING AND CONVEYANCING) c) Subject Code (e.g. K‐505) III. Bottom Right Side‐ Submitted by— a. Name of student b. Roll No c. LLB 4 th^ Semester Front Page can be hand written or printed, preferably printed. I. Front Page can be in coloured paper.

3. INDEX SHEET

ƒ It can be handwritten or printed, preferably printed. ƒ Proper page no. should be indicated. ƒ It is mandatory to include Index Sheet.

4. CONTENTS PAGE

ƒ Pages should be properly numbered.

ƒ No Of Pages: not to be less than 100 pages. ƒ Binding: only Spiral Binding SIDE MARGINS: ƒ Space for side margins should be left on all sheets, however no lines for same should be drawn or printed –anywhere in file. ƒ Left‐1.5 inch ƒ Right‐ 1 inch ƒ Top‐ 1 inch(however if on a page ,a new topic/chapter starts then TOP MARGIN is to be 1. inch)

ƒ BOTTOM ‐ 1 inch

IMPORTANT NOTE:

Type Of Paper

  1. All Sheets should be plane white
  2. No side margins should be present or drawn.
  3. Paper should be plane A4 without any lines.
  4. No decorative papers are to be used.
  5. All hand written file made on a simple A4 sheet is preferred.
  6. No. Of Pages should not be less than 80.
  7. Dividers: Dividers between two topics if included, should be on a plain white A4 paper, not on coloured papers. GUIDELINES REGARDING PROJECT FILE AND PRACTICAL DATE
  • Get your file checked within September month, from me.
  • On the date of practical and VIVA( 50 marks),bring project file, duly checked and signed by me or the HOD
  • Come in proper Advocate’s uniform.
  • Before giving VIVA, clear all dues of current semester from college.

Content Of Project File

The Project File will include following 10 written exercises in Drafting of Pleading carrying 20 Marks ( Marks for each Exercise) and following 10 written exercises in Conveyancing carrying 20 Marks ( Marks for each exercise).

Part‐I‐(20 marks)

Drafting Of Pleading (Civil & Criminal) Chapter‐I: Define Pleading and Basic Principal of Pleading. Chapter‐II: Define Plaint & Written Statement and write its essentials. Chapter‐III: Draft a Plaint and written statement for specific Performance of Contract for Purchase of Land Chapter‐IV: Draft a Notice U/S 138 of the Negotiable Instruments Act. Chapter‐V: Draft a Plaint and written statement for the Suit for Defamation. Chapter‐VI: Draft a petition for Conjugal Rights under Hindu Marriage Act, 1955. Usual affidavit to be filed in this petition. Chapter‐VII: Draft a Writ Petition under Article 226 of the Constitution (Mandamus). Chapter‐VIII: Draft Petition for Maintenance. Chapter‐IX: Draft a Bail Application. Chapter‐X: Draft Criminal complaint by Hindu Wife against her husband for Second Marriage
