INTRODUCTION TO PROPERTY
The term property is derived from the latin term propertietat which means a thing owned.
Property may be defined as objects over which the right of ownership extends and over which
one has the exclusive right of control and disposal. Thus, any object that is owned is called
property.
Defination
PROPERTY IS A PART OF HUMAN PERSONALITY” KANT
"property" means any form of property including movable and immovable property, and includes
an intellectual property right. -Art 25 constitution of Nepal
Any cash, goods or work shall be deemed to be a property if such cash, goods or action can be
used or transacted in or the title thereto can be transferred by way of purchase, sale or otherwise
or any benefit can be derived therefrom. – Section 251 civil code 2074
Kinds of property
Property is basically of two categories : Corporeal Property and Incorporeal Property.Corporeal
Property is visible and tangible, whereas incorporeal Property is not. Moreover, corporeal
Property is the right of ownership in material things, whereas incorporeal Property is an
incorporeal right in rem. Corporeal Property is further categorized into Movable and Immovable
Property. Incorporeal Property is classified into two categories : in re propria and rights in re
aliena or encumbrances.
