_____________________________________________________________ referred to as the OWNER; -and- KFH BUILD of B32 LOT 29 Green Acres, Bacolod City, duly represented hereinafter referred to as the CONTRACTOR. WITNESSETH: WHEREAS, a thorough estimation and bidding was conducted on ____________________ for the CONSTRUCTION of the Second Floor Extension; WHEREAS, time is the essence of this contract; NOW, THEREFORE, for and in consideration of the foregoing premises and other hereinafter named, the parties agree as follows: I - SCOPE OF WORK THAT the CONTRACTOR shall in accordance with the provision of and subject to the condition contained in the documents. IV - GENERAL CONDITION

A. All materials and consumables shall be supplied by the Contractor. Ordering of materials shall be taken progressively as the need arises. B. Excess materials, scraps, scaffolds, forms, tools, equipment and other temporary structures being delivered, installed, deployed, and constructed on site by the Contractor are properties of the Contractor. C. First day of construction shall be considered Seven (7) days after the receipt of the advance payment. D. Project Time extension shall be granted to the Contractor for the accumulated unworkable days due to force-majeure and other adversities beyond the control of the Contractor e.g. bad weather. Time extension shall be based on the actual unworkable days as indicated in the “Daily Record Sheets” or log book. E. Permits & Licenses-(Not included) The CONTRACTOR hereby guarantee the works stipulated in this contract and all the materials it will apply and use in the construction as well as workmanship of all its work under this contract and shall make good of its own account and/or its own expenses. V - CONTRACT SIGNING AND ACCEPTANCE Should any court action be instituted by the OWNER or CONTRACTOR arising from this contract, the parties hereby agree.
