Erroneous lawsuits are reacting havoc on allotted budgets and students are the ones paying the ultimate price. Describe the client/organization by providing some background and describing the context in which the business problem or need occurs. West Benton Unified School District (WBUSD) is a nonprofit public educational institution located in Braxton, California with 6,109 active employees. It is the second largest District in Mulberry County and consists of nineteen elementary, seven middle, and five high schools. For the 2017-2018 fiscal year, enrollment reached an all-time high of 31,644 students since its opening in 1888. WBUSD believes that people are their most valuable resource and has three core values that governs the District’s policies and procedures; commitment to student equality, safety, and the profession. Currently the District is in the midst of four high profile lawsuits with former and active employees; then six additional high cost lawsuits/settlements with students who were failed due a safe educational environment. There are a grand total of sixteen employees and/or administrators who are currently placed on paid administrative leave. These individuals have conducted themselves in a manner that is unfit to be in the proximity of their peers and students, but are receiving full compensation and fringe benefits. The amount of money the District is bleeding into toxic employees has halted the advancement in technology and outside programs for K-12 students. When did the organization become aware of the problem? What actions, if any, have been taken to mitigate the problem? In January of 2013, it was brought to light that an account at WBUSD had embezzled over 3 million dollars from the student lunch program over an eight year period. It is believed that she did not act alone; the Superintendent and Associate Superintendent were also suspected to have a role in the misappropriation of funds. The former
account, Superintendent, and Associate Superintendent have all been terminated, but several tenure employers from that regime are still actively employed at West Benton Unified School District. Identify the person in the organization (by position or title only) that authorized you to resolve the problem: Job title: Fiscal Services Supervisor – Position Control Optional comments: My current position is in Risk Management, so I am privy to confidential matters, lawsuits, and employment practices at West Benton Unified School District. What three functional areas might be contributing to the problem? Describe why these functional areas are contributing to (causing) or are affected by the problem. Do not focus on the solution when identifying your functional areas. Human Resources: Due to the enormous staffing needs at West Benton, the Human Resources department has been under intense pressure to fill positions as quickly as possible. With the added urgency, many technicians are failing to complete their due diligence when selecting applicants for a candidate pool. As a result, the hiring of employees who have had poor work history, suspect behavior at past District’s, and educators with uncompleted credentials have taken residency within our facilities. The District has seen an 8.2% decrease in state wide testing scores because of sub-par instruction and inexperienced staff. Leadership: Complete and utter disgraceful acts of unethical behavior are viewed as normalcy and the lack of accountability has led to sexual relationships between staff & students and allowance of peer bullying at several school sites. Although a handful of toxic employees have been removed from their appointed duties; we are still left with leaders who were trained by the heads of the old administration. These employees have a “what’s in it for me” attitude and stop at nothing to take advantage of every system possible in order for their individual prosperity. With leadership demonstrating these values, it has trickled down upon the workforce. As a result we have experienced a seventeen percent turnover increase at sites with peer bullying and poor management; several of which were our most talented professionals. Financial: Ineffective hiring and lack of ethical leadership is directly interfering with the financial standing of WBUSD. With three million of embezzled funds, ten lawsuits/settlements within the last three years, and sixteen employees receiving full compensation while out on leave; the District has been forced to cut a great amount of funding to afterschool programs, athletics, technology advancement, and the music program. The allocation of resources is askew and the students are directly affected by the fraud of toxic employees.
