1.0 Purpose
To comply with the BQA legislation under which ELSIMATE i s bound and to ensure ELSIMATE
delivers a transparent, effective and efficient Learner Fee refund process.
2.0 Scope
This policy applies to past learners, current learners and app licants, their authorised representatives
and/or official sponsors seeking a refund of Learner Fees
The Refund of Learner Fees Policy applies to all Tuition Fees
- Learner Contribution Amounts and Course Money received by ELSIM ATE or a third party
acting under contract on behalf of ELSIMATE
- Applies equally to Monies received either directly or indirec tly from the Learner.
- This policy also applies to refunds relating to Miscellaneous Le arner Fees, Fines and Charges
as defined, internal learners’ health cover and credit balances on Learner Accounts.
3.0Policy Statement
Under the guidance and framework provided by the BQA Act, and Quality Assurance Standards, ELSIMATE will
conduct all Learner Fee refunds ethically, honestly and with fai rness to all parties
Unless as required under legislation, this Policy will be applied equally, in the context relevant to the circumstance, to all
learners, past learners and applicants of ELSIMATE. 4
.0 Principles
ELSIMATE will:
Ensure its Refund of Learner Fees Policy is publicly available to all Learners and Applicants before admission and enrolmenet.
Ensure Learners have an option to leave credit balances on their Learner Account to be applied against future liabilities the
Learner may incur with ELSIMATE
Ensure International Learners are given access to a copy of t his Policy prior to accepting a place at ELSIMATE under a Learner
Visa. Enter into a written agreement with the International Lear ner, concurrently with or prior to accepting Course Money
from the Learner, that contains information regarding refunds of Course Money. “This (written) agreement, and the availability
of Complaints and Review of Decision processes, does not remove the right of the Learner to take action under 's consumer
protection law.
Include a clause in all Education Partner contracts (including Supp ort Offices) regarding the refunding of Course Money
received for ELSIMATE Enrolment, to ensure the Educati on Partner's refund policy is consistent with this Policy.
Through the Education Partner review process, ensure their refu nd practices are clearly stated and publicly available
5.0 Procedures
Grounds for a Refund and Establishing the Amount to be Refunded
Tuition Fees and/or Learner Contribution Amounts
A Learner is entitled to a refund of Tuition Fees and/or upfront Learner Contribution Amounts under the following circumstances:
A Learner, who withdraws their Enrolment in a Course before the last date to drop Courses in that Semester is eligible for a reversal of Learner Fees and a full refund of Monies paid upfront for that
Course, with the exception of an International Learner in their first six months of on-campus study at ELSIMATE, who requests a transfer to another registered and accredited provider
An International Learner, in their first six months of on-campus study at ELSIMATE, who requests a transfer to another registered and accredited provider must apply for a Letter of Release.
Where ELSIMATE grants a Letter of Release, before the last date to drop Courses in that Semester, the International Learner is eligible for a reversal of Learner Fees and a full refund of Monies paid
upfront for their Course(s) in that Semester.
Where ELSIMATE grants a Letter of Release, after the last date to drop Courses in that Semester, the International Learner isnot eligible for a reversal of Learner Fees or a refund of Monies paid
upfront for their Course(s) in that Semester
All Learner Contribution Amounts must be made by the Learner on or before the last date to drop Courses for a Semester
Where ELSIMATE records indicate a Learner has made a payment after the last date to drop Courses, ELSIMATE cannot accept thispayment, and will refund the Monies to the Learner
A Learner who is granted “Withdrawal without Academic Penalty and with Fee Reversal” is eligible for a reversal of Learner Fees and a full refund of Monies paid upfront for that Course
The offer of a place to a Learner is withdrawn by ELSIMATE or ELSIMATE is unable to provide the Course or the Programme
The Learner is entitled to a full refund of Monies paid in advance for the Course or for Courses in that Programme
A Learner fails to meet programme progression requirements and is thus not permitted to re-enrol
The Learner is entitled to a full refund of Tuition Fees and/or upfront Learner Contribution Amounts paid in advance of provision of Notice of Exclusion
Withdrawal due to Compassionate and Compelling Circumstances that has been accepted by ELSIMATE
ELSIMATE may refuse to provide or continue to provide a Programme to a Learner in one or more of the following circumstances:
The Learner, or their Official Sponsor, failed to pay an amount he or she was liable to pay ELSIMATEdirectly or indirectly inorder to undertake the Programme
The Learner breached a condition of his or her Learner Visa (where applicable)
Through the Education Partner review process, ensure their refu nd practices are clearly stated and publicly available
Develop and make publicly available Learner Complaint Manage ment and Review of Decision procedures for issues regarding
Learner Fee refunds
The Learner breached a condition of his or her Learner Visa (where applicable)
Misconduct by the Learner in accordance with ELSIMATE's policies on misconduct.
