RCFE Certification
Ambulatory person -
Means a person who is capable of demonstrating the mental competence and
physical ability to leave a building without assistance of any other person or without the use
of any mechanical device incase of an emergency (basic cane ok, quad cane not)
Appropriately skilled professional -
Means an individual that has training and is licensed to perform the necessary
medical procedures prescribed by a physician. Includes, not not limited to: rn, lvn, pt, ot, rt.
these professionals may include, but are not limited to, those employed by a home health
agency, the resident or facilities and are currently licensed in ca.
Basic services -
Means those services required to be proved by the facility in order to obtain and
maintain a license and include, in such combinations as may meet the needs of the residents
and be applicable to the type of facility to be operated, the following: safe and healthful
living accommodations; personal assistance and car; observation and supervision; planned
activities; food service; and arrangements for obtaining incidental medical and dental care
Capacity -
Means that maximum number of persons authorized to be provided services at any
one time in any license facility
Certificate holder -
Means a person who has a current administrators certificate issued by the dept
regardless of whether the person is employed as an administrator in a residential care facility
for the elderly
Conservator -
A person appointed by the superior court to care for the person estate or both of an
adult
Control of property -
The right to enter, occupy and maintain the operation of the facility property within
regulatory requirements
Deficiency -
Any failure to comply with any provision of the RCFE and regulations adopted by
the dept pursuant of the act
Dementia -
The loss of intellectual function and other cognitive functions sufficient to interfere
with an individual's ability to perform ADL's or to carry out social or occupational activities
Elderly person -
For purposes of admission into a residential care facility for the elderly, a person
who is 60 yrs or older

Emergency approval to operate - Means a temporary approval to operate a facility for no more than 60 days pending the issuance or denial of a license by the licensing agent Exception - A variance to a specific regulation based on the unique needs or circumstances of a specific resident or staff persons Exemption - Variation to the law Healing wounds - Cuts, stage 1 and 2 dermal ulcers as diagnosed by a physician and incisions that are being treated by an appropriate skilled professional with the affected area returning to its normal state Health condition relocation order - Written notice by the dept to a licensee requiring the relocation of a resident from a RCFE because the resident has a health condition which can't be cared for within the limits of the license. This is bad!! Medical professional - Includes but not limited to MD, RN, LVN that is licensed in CA Mild cognitive impairment - People whose cognitive abilities are in a "conditional state" between normal aging and dementia. Non-ambulatory person - A person unable to leave a building unassisted under emergency conditions. Either due to mental or physical reasons Non-compliance conference - A meeting initiated by the dept that takes place between licensing and the licensee to afford the licensee an opportunity to correct licensing violations. This is very bad!! Provisional license - A temporary, nonrenewable license, issued for a period not to exceed 12 months which is issued in accordance with the criteria specified in section 87162 RCFE - Housing arrangement chosen voluntarily by the resident here 75% of the residents are 60+ and where varying leeks of care and supervision are provided. Responsible party - An individual who assists the resident in placement or assume varying degrees of responsibility for the residents well-being Serious deficiency -

Time allowed to notify ccl when hospice care has commenced, changed or discontinued 7 days - Time allowed to have new employees get a health screening 7 days - Time allowed to sign an admission agreement 7 days - Amount of non perishable food supply on hand 7 days - Time allowed to report a death or injury of a resident 10 days - Time ccl has to respond to a complaint regarding a licensee 10 days - Time allowed to notify ccl of a change in licensee mailing address 10 days - Time allowed to request notice of deficiency review in writing 10 days - To appeal a civil penalty assessment 10 days - Time allowed to submit Documentation of health related conditions of a resident 15 days - Time allowed to notify ccl of a change in executive order 15 hrs - Maximum allowed time between 3rd and 1st meal 30 days - Time allowed to require notice for change in licensee, type of license or location 30 days - Amount of time for an eviction 30 days - Maximum amount of time to correct a cited deficiency 30 days - Notify ccl of a change in administrator 30 days - Maximum time allowed to obey a relocation order

60 days - Time in advance to give written notice to a resident of a change in services rates 60 days - Time to notify ccl of a change in ownership 90 days - Time ccl has to inspect a new facility 3 months - Amount of operating costs a licensee must have available 6 months - Maximum amount of time a new employee can use a prior health screen 12 months - Maximum length of time allowed for a provisional license 12 months - Maximum length of time allowed for physicians report to be completed before move in 24hrs - One allowed to file a report of fire or explosion 24hrs - Time allowed to notify ccl of a licensee death 3 yrs - Time personnel records must be maintained 3 yrs - Time resident records must be maintained 3 yrs - Time drug destruction records must be maintained 6 beds or less - Size of building that must only keep a sample menu on file 7 beds or larger - Size of building that must post the procedure for filing complaints 7 beds or larger - Size of building that just post copy of resident rights 7 beds + - Size of building that must post notices of all planned activities

Minimum Temperature the building must be heated to 78-85 degrees - Temperature the building must be cooled to 105-120 - Temperature hot water must be heated to for resident use

125 degrees - Temperature of hot water that requires a warning sign 0 degrees - Required freezer temperature 40 degrees - Required refrigerator temperature Information required by RCFE license applicant must provide - Info concerning insurance carried by the applicant relating to the operation of the facility The name, address, and phone number of the fire dept having jurisdiction in the area Such info that may be required by licensing for proper administration and enforcement of the licensing law and regulations Crimes not eligible for exemption - Arson Any mayhem Violent felony Steps to take after a licensee's death - notify the dept by the next working day inform the dept within 5 days if the designee decides not to apply for a licensure and implement a relocation plan for residents If designee decides to apply for a licensure, than get an EAO, and file for application for licensure 30 days - Time that must lapse before a sale of the facility Where to post a licesnse - In a prominent location in the licensed facility accessible to public view 2 years - length of time an administrator's certificate is good for, before needing to be re- certified 40 hours - number of continuing education hours that must be completed every 2 years to re certify an administrator's certificate

20 hours - number of continuing education hours that can be completed online 8 hours - number of continuing education hours that must be on serving clients with dementia facility manager - a person on the premises with the authority and responsibility necessary to manage and control the day-to-day operation of a residential care facility for the elderly and supervise the clients. 10 hours - number of initial training hours for any staff members that assist residents with ADL's 4 weeks - length of time a new employee has to complete the initial 10 hours of training 4 hours - number of continuing education training staff members must complete each year. 6 hours - number of initial dementia training hours required for all facilities that advertise dementia care 8 hours - number of in service training hours required each year for facilities that advertise dementia care 5 reasons why a licensee shall notify the department, ombudsman, and all residents within 2 days -

  1. notice of default, notice of trustee's sale, or any other indication of foreclosure is issued on the property
  2. unlawful detainer action is initiated against the licensee
  3. licensee files for bankruptcy
  4. licensee receives a written notice of default of payment of rent described in section 1161 of the code of civil procedure
  5. a utility company has sent a notice of intent to terminate electricity, gas or water services on the property within not more than 15 days of the notice 16 hours - number of initial training hours that must be provided to all staff assisting resident with medication in facilities 16 beds or larger 6 hours - number of initial training hours that must be provided to all staff assisting residents with medication in facilities 15 beds or fewer
