Levine Case of 2009 in the Supreme Court of the United States involved Diana Levine, a woman who had encountered severe complications after being given a medical injection of anti-nausea by Wyeth, Phenergan. The significant method that was used was the IV-Push methodology, which contributed to the subsequent gangrene amputation of the arm of Levine. The main issue of the case was whether Wyeth had warned adequately based on the underlying risk linked with the IV-push injection method. The central holding of the United States Supreme Court was on the side of Dina Levine with the argument that the federal rules and regulations didn't pre-empt the state laws in the claims, and Wyeth had failed in offering adequate warning based on the underlying risks on the use of the injection method. The decision from the Supreme Court emphasized that the companies dealing with pharmaceuticals had the duty of offering precise and sufficient information based on the warning about underlying risks linked to the product. I agree with the Supreme Court's argument that the pharmaceutical companies were on the wrong side of the case, as they should indicate the potential consequences of risk associated with the use of particular methods or products. I would argue based on ethical principles guiding decision-making, such as the autonomy that entails the respect of individual's autonomy involving the provision of comprehensive information in making informed decisions and choices about one's health. Adhering to the individual's autonomy is aligned with the main idea that the patients in a hospital have the freedom and right to comprehend the potential risks and consequences linked to the use of a particular drug.
In addition, the other principle that would guide our argument is the principle of beneficence, in which acting with the main interests of the patient is key. The provider needs to provide accurate and precise information based on the potential risks and consequences, which is beneficial in making certain of the health of the individual. Therefore, making certain of the just distribution of the main benefits and consequences or risks is essential. Levine had the right to comprehend both the risks and benefits, and failure to offer the warning led to the disproportional harm caused by the medication administered to her. From the case provided, I can provide different considerable advice to a pharmaceutical company that is looking forward to labeling a drug, thus helping in balancing the risks and benefits of the use of the drug. Based on the ethical principles governing the rights of the person using the medicine, the company needs to have a comprehensive strategy for communicating the potential risks that can be caused by the use of the drug.This implies the precise communication of all the underlying risks as linked to the drug, using a language of communication that is precise and comprehendible by the individuals as well as to a normal individual. This also involves keeping the drug labels clear, which portrays the dedication of the company to transparency and honesty in making certain that the customers are informed on the current safety information on the drug. In addition, the company needs to consult with medical experts even before releasing the drug to the market. This will engage the medical expertise to examine and evaluate the main potential risks of the use of the drug in an accurate way. This will help in demonstrating the highest level of dedication in the reliance on the best knowledge in the field. The involvement of medical experts in examining the drug will help in the adherence to legal and regulatory standards that make certain that legal obligations governing the use of the drug are met, which helps in mitigating the liability risk that can be posed by the drug.

This makes certain that the industry operates in a bound of ethical and lawful standards. Significantly, ethical theories mainly prioritize the needs and rights of the individuals based on their autonomy, which may raise the issues of privacy implications on the streaming services that gather and evaluate the data of the users. From a right-based argument or standpoint, the concept of privacy has potential infringement. The ethical theory of egoism does not explain my standpoint due to the argument and prioritization of self-interest, which is questioning if the actions of streaming are involved in the exploitation of the practices or if the leading artists are not justly compensated through payment of their work (Bench-Capon, 2020). From that perspective, the ethical theory emphasizes more on equity, justice, and fairness based on the protection of the rights of the people, which provokes the ethicality of the actions in relation to the consumption of music.
