Muhammad Asif Versus Sadia Naz
(Suit for Specific Performance )
LOCAL COMMISSION REPORT
The undersigned was assigned local Commission (hereinafter referred to as
“Commission”) in the above-mentioned suit by this learned Court vide order dated
09.10.19 (hereinafter referred to as “order”). The commission was assigned the duty
of preparing a detailed report regarding the points mentioned below:
I. In whose possession the suit property situated at Moza Gangal, Tehsil and
District Islamabad is? (The mandate is already fulfilled in earlier report)
II. What is the market rental value of the suit house? (which was remained
unattended hence, this supplementary report.
The commission intimated both the parties on their given mobile numbers and
mentioned that the remaining mandate only requires to determine the monthly rental
value of the suit house and it does not necessarily require the presence of parties and
left it on their choice whether to come on spot or not. Th location of the suit house
was already in the knowledge of Commission; hence it was not difficult to identify the
house and get it’s monthly rental value from nearby property deals/ real estate
advisors.
The Commission reached the spot at 04:00 PM on 26th of November 2019 reached
the suit house and there the commission met the occupant of the suit house “Mian
Jamshed Ahmad” then, the Commission inquired about the rental value of the suit
house from the following property deals/ real estate advisors:
1. Real Estate Advisor who was referred by Mian Jamshed Ahmad named as
(Al-Wahab Estate) with office located in Ali Market Ghori Town Phase-III,
he mentioned it’s rental value ranging from Rs. 13,000- 15,000/ month of
the suit house. (He’s the only Property dealer who was contacted with the
help of Mian Jamshed Ahmad, rest of all were reached and contacted by
the commission himself)
2. Real Estate Advisor named as Qutab Shahi Associates also located in Ali
Market, Ghori Town Phase-III mentioned rental value ranging from Rs.
18,000 to Rs. 20,000 of the suit house. (Malik Shaukat named person dealt
with the Commission on behalf of Qutab Shahi Associates)

Real Estate Advisor named as Al-Mehriya properties with their office located on the Main Service Road just on the entrance of Ghori Town Phase-III mentioned rental value ranging from Rs. 18,000 to Rs. 20,000 of the suit house. (Asif named person dealt with the Commission on behalf of Al- Mehriya Properties)
  2. Real Estate Advisor named as “Saudaagar Associates” with their office located in Ghori Town Phase 4-A, they also stated the rental value of the suit house to be ranging from Rs. 18,000 to Rs. 20,000 per month.
  3. The Commission also inquired about the rental value of 5 Marla House, single story built and having no gas connection installed in the Street No. 24 of Ghori Town Phase-III from few residents and shopkeepers in the vicinity, they all mentioned it ranging from Rs.18,000 to 20,000/ month.

Therefore, it is concluded that the market rental value of the suit house ranges from Rs. 18,000 to Rs. 20,000.

Report is placed on record for kind perusal of learned court.
